Busyro Muqoddas` Leadership, KPK and Golkar

M. Busyro Muqoddas` election as the new chairman of the Corruption Eradication Commission (KPK) is a test for the commission whether nor not it can handle unresolved high profile corruption cases in Indonesia.

For the Golkar Party, what is perceived as high profile cases needs to be resolved by Busro, who won the KPK`s top seat after grabbing 34 votes of the 55 members of the House of Representatives` (DPR) commission on legal matters against his rival,

Bambang Widjojanto, on Thursday, is the Bank Century scandal; not Gayus Tambunan`s tax fraud case as also been expected by the public.

The Golkar party`s expectations of the KPK to reveal the scandal, triggered by the central government`s decision to rescue failed Bank Century with a total of Rp6.7 trillion in bailout funds, was expressed by Bambang Soesatyo and Nurdirman Munir.

These two members of the Golkar Party faction at the House of Representatives` (DPR) commission on legal matters asked Busyro to do so during his fit-and-proper test and his rival Bambang Widjojanto, on Wednesday.

At that time, Bambang Soesayto asked Busyro, who previously chaired the Indonesian judicial commission, not to get dragged into the "KPK`s current condition".

The temporary conclusion of the KPK itself, regarding the Bank Century case, has confirmed the absence of "proof of corruption".

Apart from the KPK`s official stance over the scandal that has involved the names of incumbent Vice President Boediono and former finance minister Sri Mulyani, Bambang Soesatyo underlined the House`s conclusion last March.

The House had concluded at its plenary session that the bailout policy had covered up irregularities, violations of banking regulations and criminal laws, instances of corruption and money laundering.

Nudirman Munir, other member of the Golkar Party faction at the House`s commission on legal affairs, said the KPK was expected to be able to take "more comprehensive steps" to handle the unresolved Bank Century bailout case.

Last October, the Golkar Party`s cadre at the parliament, Priyo Budi Santoso, also expressed the same message to National Police Chief-designate Commissioner

General Timur Pradopo about the revelation of the case, often linked to the government and the ruling Democratic Party (PD).

"We hope the Bank Century case can be resolved, including revealing the flow of bailout funds because it remains floating without a final revelation," said this DPR`s deputy chairman.

And what about the Gayus Tambunan case? Is it also perceived by Golkar as a high profile case that needs also be handled or taken over by the KPK under Busyro`s leadership?

Unlike its strong encouragement to the KPK to reveal he Bank Century bailout scandal, the Golkar Party politicians seem reluctant to join the voices of critical elements in the Indonesian society who call on the KPK to take over the Gayus Tambunan case.

Golkar Party Chairman Aburizal Bakrie himself said he agreed with President Susilo Bambang Yudhoyono`s view that Gayus Tambunan`s tax fraud case should remain in the hands of the police.

"Let the police handle the Gayus Tambunan case. Don`t create the impression as if the police is not capable of resolving it," Aburizal old newsmen at the Golkar Party headquarters here on the day Busyro was elected.

Speaking before attending a routine party meeting here, he said the national police had a good track record in handling criminal cases so they could not be suddenly regarded as "incapable".

Therefore, the people could not ignore the police`s achievements in the handling of various cases, he said.

Aburizal Bakrie himself has been associated with Gayus especially with regard to an alleged case of tax fraud involving PT Kaltim Prima Coal, a subsidiary Bakrie Group.

He said he was waiting for the outcome of the national police`s investigation into Gayus Tambunan`s statement that the anti-legal mafia task force tended to link his case to the Bakrie group`s enterprises.

In connection with this matter, critical elements in the Indonesian society, such as the Muhammadiyah leader and Indonesian Corruption Watch (ICW) activists, wanted the Corruption Eradication Commission (KPK) to take over the Gayus Tambunan case.

Muhammadiyah leader, Din Syamsuddin, said the KPK could reveal the truths behind the case more immediately and transparently.

The top leader of Muhammadiyah, Indonesia`s second biggest Islamic organization, said the KPK could even help realize the government`s commitment to fighting corruption crimes.

"Combating corruption needs concrete and serious action, not just a rhetoric," he said.
The ICW`s Coordinator for Legal and Court Monitoring Affairs Febri Diansyah had earlier urged the KPK to take over the handling of Gayus Tambunan`s case because the commission won public trust. "This is what the police do not have this time," he said.

Febri Diansyah said the commission could take the Gayus Tambunan case over because the police and public prosecution office could not do their job effectively for various reasons.

Gayus Tambunan was found relaxing in the resort island of Bali recently while he was officially detained at the Police Mobile Brigade detainment center in Depok, West Java.

There was a strong public reaction to the publication of a picture showing a man resembling Gayus watching an international tennis match in Bali on November 5.
The case of this junior civil servant working at the tax office caught wide public attention after the police named him suspect for having a suspicious Rp25 billion bank account last March.

Gayus had been moved from the police detention center in Depok to the Cipinang maximum security prison following the revelation of his illegal "holiday" with his wife in Bali.

In connection with media reports about Gayus` holiday, Aburizal Bakrie had even reported some print, electronic and online media to the Indonesian Press Council for what he called as "false news reporting" about a meeting between him and Gayus in Bali. Among them are Kompas, Detik.com, Media Indonesia and Metro TV.

The Gayus Tambunan case is currently being tried in a district court in the Indonesian capital of Jakarta. In this tax fraud case, some police accomplices are allegedly involved.

The Bank Century and Gayus Tambunan scandals may only be the tip of an iceberg that show the vulnerability of Indonesia to the real threats of corruption crimes.

Referring to the outcomes of the 2010 corruption perceptions the index survey (CPI) that the Transparency International Indonesia (TII) released last October, Indonesia`s CPI score remained at 2.8, changed from that of the previous year.

With the CPI score, Indonesia remained at 110th position out of 178 countries that 10 independent institutions had surveyed from January 2009 to September 2010, the TII activist, Todung Mulya, said.

Indonesia`s position was only better than Myanmar`s but far left behind by Singapore, Brunei Darussalam, Malaysia and Thailand, he said.

Under Busyro Muqoddas` leadership, the KPK`s capability of crushing corruptors to enable Indonesia to become one of the least corrupt countries on earth is tested!
